OSP Public Records request 96362
After my January 27, 2025, visit my Oregon Representative, Shelly Boshart Davis (SBD), I requested the bodycam footage from the Oregon State Police (OSP). I emailed central.records@osp.oregon.gov on February 5th at 15:12. Here is what I wrote:
Reason for Request: “Public interest, government accountability”
Requested Records: “I am requesting body cam footage taken of me by OR State Troopers in Rep. Boshart-Davis' Legislative Office.”
Location of Incident: “Office H-389, State Capitol”
Type of Incident: “Public employee raised their voice after falsely accusing me of making threats just before Troopers were called”
Twice, on February 12 and 18, my request was denied. The grounds cited by Records Specialist Katherine Parks was that “There is no indication that disclosure in this particular instance will primarily benefit the general public.” Here are the two letters;
To the 20250212 rejection, I replied
This is my second request for disclosure under ORS192.345(40)(b).
This email is to reiterate that my initial request included 1) "the approximate date and time... requested," and 2) the "public interest requir[ing] disclosure."
As the possessor of the footage in question, it is OSP's responsibility to tailor the footage to meet the requirements of subsections (b) and (c).
I look forward to receiving the footage. Thank you.
To the 20250218 rejection, I replied
This is my third written demand for audio and visual records from a PUBLIC office on PUBLIC property of an ELECTED official's staff mistreating a United States Citizen and Resident of Oregon.
The public interest is self-evident. The burden to prove otherwise rests upon the OPS, not private individuals.
If the records are not produced and transmitted by midnight on Sunday, February 23, 2025
Two things will occur:
I will report a civil rights Violation to the Federal Bureau of Investigation
I will file a civil suit under Title 42 United States Code § 1983
